Appellant was convicted in district court for the Southern District of Texas, under the Controlled Substances Act, 21 U.S.C. § 841(a)(1), for knowingly or intentionally possessing in excess of 100 kilograms of marihuana, with intent to distribute. Appellant was also convicted of attempting or conspiring to possess more than 100 kilograms of marihuana, with intent to distribute, under 21 U.S.C. § 846.
