On the 14th day- of October, 1940, the. plaintiff, O. H. M. Williams, filed his petition for partition of the N.1/2 of the S.W.% of section 18, township 21, R. 8, Pawnee county, Okla., consisting of 80 acres. In an amended petition he included some real property located in the city of Pawnee which is not at this time involved in the proceedings. The plaintiff is the owner of a one-sixth undivided interest in said 80 acres of land inherited from his mother.
