I am unable to concur in the decision of this case. The appeal is from a summary-judgment entered by the District Court of the United States for the District of Columbia against the appellants Helen H. and Royal T. McKenna, husband and wife, plaintiffs below. The appellants filed suit against the appellee Thomas Austin for damages alleged to have resulted from injuries received by the appellant Helen H.
