The plaintiff in error was convicted in the district court of the crime of libel and sentenced to pay a fine and the costs of prosecution. From that judgment he brings error.
It appears that a motion for a new trial was filed in the district court and denied; but the denial of that motion is not assigned as error in the petition in error, therefore, the only alleged errors which are here for consideration are those stated in the petition in error.
