OPINION

WEISBERGER, Chief Justice.

This case comes before us on appeal from judgments and orders entered in the Superi- or Court for the County of Kent. We vacate the judgments and orders and remand the case to the Superior Court for a factual and legal determination in accordance with guidelines that shall be set forth below. The facts of the case insofar as pertinent to this appeal are as follows.
