People v. Taylor

Appellate Division of the Supreme Court of the State of New York

Decided April 12, 2004PublishedCited by 4 opinions

1Opinion of the Court

Appeal by the defendant from a judgment of the County Court, Suffolk County (Pitts, J.), rendered November 1, 1999, convicting her of murder in the second degree, and imposing *557sentence. The appeal brings up for review the denial, after a hearing, of that branch of the defendant’s omnibus motion which was to suppress identification testimony.

Ordered that the judgment is reversed, on the law, and a new trial is ordered. The facts have been considered and determined to have been established.

We concur with the County Court that the photographic identification procedures were not unduly suggestive.
