The Plaintiff filed hisbill in 1869, vs. Reuben Davis-son, adm’r of Caleb M. Felton, setting forth that said Felton was in debt to him, said Plaintiff, in the amount of a single bill for $36.45, executed by him to the firm of Strickler & Co., and by said firm assigned to the Plaintiff. The bill alleges that there are no assets in the hands of the adminstrator, and prays that the real estate of the'intestate, Caleb M. Felton, may be subjected to the payment of Plaintiff’s claim.
