MEMORANDUM DECISION

Before the Court is a motion by the Nassau County District Attorney (“DA”) and the County of Nassau (the “County”) (collectively, the “Defendants”) seeking reconsideration of the Court’s Memorandum Decision (“Decision”) and Order dated March 2, 2009 denying the Defendants’ motion for summary judgment in this adversary proceeding. The Defendants move for relief pursuant to Fed.R.Civ.P. 60(b)(1) (“Rule 60(b)(1)”) due to alleged mistakes of fact and law contained in the Decision (“Motion”).
