In an ac*307tion to recover damages for personal injuries, the defendant Betsy Guerra appeals, as limited by her brief, from so much of an order of the Supreme Court, Suffolk County (Hall, J.), entered November 26, 2002, as denied her motion for summary judgment dismissing the complaint insofar as asserted against her on the ground that the plaintiff did not sustain a serious injury within the meaning of Insurance Law § 5102 (d).

Ordered that the order is affirmed insofar as appealed from, with costs.
