ORDER GRANTING SUMMARY JUDGMENT

RUSSELL G. CLARK, District Judge.

This action is before the Court upon stipulated facts and cross motions for summary judgment filed by plaintiffs and defendant. For the reasons stated herein, the plaintiffs’ joint motion is granted and the defendant’s motion is denied.

Plaintiffs, Sue Ann Hunter, Marie Joyce Kotsonis, L. Fargo Richardson, Jr., and L. F. Richardson Foundation, are the sole distributees and beneficiaries under the last will and testament of Lloyd F.
