BARRETT, Commissioner.

A jury found William Gene Merritt “guilty of assault with intent to kill, with malice aforethought” and since he had prior felony convictions the court fixed his punishment at forty-five years’ imprisonment.

Upon this appeal Merritt has been represented by two vigilant, diligent lawyers and they have briefed and argued several claims of error including a charge that the evidence is insufficient to sustain the alleged charge and verdict.
