— This is a suit by Gr. W. B. McDonald, administrator of the estate of Henry S. Burton, deceased, brought to subject certain real estate situate in the county of San Diego, and known as the Rancho Jamul, to administration, the legal title thereto being, as is alleged, out of the estate. The amended complaint alleges that Henry S. Burton died intestate on .the fourth day of April, 1869, and that the plaintiff was duly appointed his administrator on the sixth day of February, 1870.
