1Opinion of the CourtMacIntyre, J.
C. S. Tyree, was convicted under an indictment which charged him with larceny after trust of an automobile. He moved for a continuance on account of the absence of a witness, who was in the United' States Army. He had continued the case once before on account of .the absence of this witness. In the instant ease the accusation alleged that the defendant was guilty of larceny after trust by converting to his own use the automobile of the prosecutor, about 10 or 11 o’clock in the morning, in Atlanta.
