Mobley, Chief Justice.

Virgil Hinson, condemnee in an action by the State Department of Transportation to condemn property for a state-aid road, appeals from an interlocutory order vesting title in the condemnor. This order had the effect of denying the motion to dismiss of the condemnee, which attacked the proceedings as violating the Constitution, Art. I, Sec. Ill, Par. I (Code Ann. § 2-301) and Art. IV, Sec. II, Par. I (Code Ann. § 2-2501), in that the condemnor is not seeking to take the property of the condemnee for public purposes. The trial judge certified the case for immediate review.
