Appeal and cross appeal from an order of the Supreme Court, Erie County (Diane Y. Devlin, J.), entered July 12, 2006 in a personal injury action. The order denied in part defendants’ motion for summary judgment dismissing the complaint and denied plaintiffs cross motion for partial summary judgment on liability under Labor Law § 240 (1) and § 241 (6).

It is hereby ordered that the order so appealed from be and the same hereby is unanimously modified on the law by grant*1168ing the motion in its entirety and dismissing the complaint and as modified the order is affirmed without costs.
