The issue to be resolved here is whether the press should be granted immediate access to motion papers, involving suppression issues, in a case that has generated significant publicity. The First Amendment to the Constitution of the United States guarantees, among other things, freedom of the press. The Sixth Amendment to the Constitution of the United States guarantees to the accused “the right to a speedy and public trial, by an impartial jury” (emphasis supplied).
