There is no conflict in the evidence. The controversy is as to the law applicable to the undisputed facts. For thirteen years the plaintiff and his wife, Agnes J., held the title to all the lands in question by deeds running-to them as husband and wife. Two- months before her death, the wife, Agnes J., deeded the undivided one-half of all of such lands to the defendant, her son by a former marriage, and took back a mortgage for the purchase price.
