Because of my view that the fraud alleged in this case has not been proven by “clear and convincing evidence”, I must dissent. Since the resolution of this issue involves factual questions, additional matters in the record must be set forth. Hopper’s initial injury occurred on April 24, 1973. He was seen on the same day by T. Sie, M.D. He was referred by Dr. Sie to Howard Aidem, M.D., an orthopedic surgeon, who saw Hopper the next day, April 25, 1973.
