Josué Mar (“Mar”) appeals the final order of the circuit court dismissing his petition for appeal from the Virginia Department of Labor and Industry (“DOLI”) decision closing his wage claim against Velasquez Constructors Corp. (“Velasquez Constructors”). Mar argues on appeal that the circuit court should have found that DOLI is required to apply procedures set forth in Article 3 of the Virginia Administrative Process Act, Code §§ 2.2-4018 through 2.2-4023, (“VAPA Article 3”) to his wage claim under Code § 40.1-29, the Virginia Payment of Wage Act (“the Wage Payment Act”).
