Plaintiff Younghee Na Huck (“Na”), a Korean citizen, entered the United States in 1979 as a nonimmigrant exchange visitor to accept a Research Assistant position at the University of Chicago. See section 101(a)(15)(J) of the Immigration and Nationality Act (“Act”), 8 U.S.C. § 1101(a)(15)(J).
