FILES, P. J.

This is an appeal by the People from an order of the superior court directing that defendant “be released pursuant to a writ of habeas corpus” unless he is granted a new trial on the charge of which he was convicted in 1960. The ground of the superior court’s decision was that in defendant’s 1960 trial a confession was received in evidence in violation of the federal constitutional principles announced in Jackson v. Denno (1964) 378 U.S. 368 [12 L.Ed.2d 908, 84 S.Ct. 1774, A.L.R.3d 1205],
