MEMORANDUM OPINION AND ORDER

THIS MATTER comes before the Court for consideration of Defendant’s (“Rhoades”) motion to amend his answer and modify an admission he made in the initial pretrial report (Doc. 20); a motion to intervene filed by John C. Craft (Doe. 26); and Plaintiffs motion for summary judgment (Doc. 31). The Court has reviewed the submissions of the parties and the relevant law.
