MORTON, District Judge.
Plaintiffs Cordell Smith and Fannie Smith own a tract of land in Cookeville, Putnam County, Tennessee, which is being condemned by the City of Cooke-ville for use in the Cane Creek Improvement Project, a proposed conservation and recreation development.
