(W. S.) Bertha Bell, plaintiff below and plaintiff-in-error in this Court, hereinafter referred to as *589the plaintiff, brought this suit against F. W. Woolworth Company, defendant below, hereinafter referred to as defendant, alleging personal injury damages in the amount of $50,000, resulting from the fall she sustained on the stairway of defendant’s mercantile building leading from its first floor to its basement, located at No. 59 North Main Street in the City of Memphis, Tennessee.
