On December 18, 1939, J. Henry De-Cumbe filed in the Circuit Court of Volusia County, Florida, his bill of complaint against the defendants, M. Elizabeth Smith, and husband, in which it was alleged that the plaintiff was the owner in fee simple of certain real estate situated in Daytona Beach, Volusia County, Florida, upon which was located a hotel known as “Orange Villa Hotel,” containing forty-five rooms worth approximately $30,000.00 or $35,000.00 and the daily receipts of the hotel amounted approximately to from $40.00 to $50.00.
