Cohen, J.), entered July 3, 1991, which, inter alia, denied plaintiffs motion to dismiss four of defendant’s affirmative defenses pursuant to CPLR 3211 (b) and granted, without prejudice, defendant’s motion to vacate *389plaintiffs demand for a bill of particulars and which granted plaintiffs motion to dismiss three of defendant’s affirmative defenses, unanimously modified, on the law and the facts to dismiss said four affirmative defenses, and otherwise affirmed, with costs.
