MEMORANDUM OPINION AND ORDER

Pending is plaintiffs’ motion to amend and remand. Defendant has responded, and plaintiffs have replied. 1 This matter is mature for adjudication.
Plaintiffs instituted this action in the Circuit Court of Jackson County, West Virginia, on July 16, 1994. In the complaint plaintiffs allege their property was damaged by a rock slide.
