— Appeal from a judgment of the County Court of Rensselaer County (Dwyer, Jr., J.), rendered July 30, 1982, upon a verdict convicting defendant of the crimes of burglary in the third degree and grand larceny in the third degree. As a result of an incident which occurred on May 15,1981 between 10:00 a.m. and 12:20 p.m. at a residence at 423 Miller Lane in the Town of Brunswick, Rensselaer County, wherein there was allegedly an illegal entry into the residence and property consisting of a Springfield rifle and $150 in United States currency was allegedly stolen therefrom, defendant and two…
