This appeal concerns the proper application of the Telephone Consumer Protection Act of 1991, 47 U.S.C. § 227 et seq. ("the TCPA"). In several respects, it shares characteristics with a number of recent cases decided by this court in appeals prosecuted by John Lary d/b/a Internal Medicine Clinic as to cases involving TCPA claims.
