The appellants, Ernest R. Lenaz and James O. Boxx, each brought separate suits in the Circuit Court of Harrison County against the appellee, Richard Conway, doing business as The Music Box, seeking the recovery of damages for an alleged false arrest and false imprisonment. The case of the appellant, Ernest R. Lenaz, was first brought to trial and resulted in a mistrial because of a hung jury. At a subsequent term of the court, by agreement of the parties, the two suits were consolidated and tried as one and resulted in a jury verdict for the defendant.
