The following charges were refused to the defendant: (1)I charge you, gentlemen of the jury, that if there is one single fact proved to the satisfaction of the jury which is inconsistent with the defendant’s guilt, that is sufficient to create a reasonable doubt in your minds, then the jury should give the defendant the benefit of the doubt and acquit him. The homicide of whicn the appellant stands convicted occurred on November 11, 1918, on Noble street in the city of Anniston, during the celebration by the people of that city of the signing of the armistice agreement. The deceased, John Baxter, was a son-in-law of the appellant. About two months before the homicide Baxter’s wife had separated from him, taking with her their only child, a boy about four years of age, and was then living at her father’s home as a member of his family.
