The plaintiff in error was tried and convicted in the district court of Woods county for the ■crime of felonious assault. From the judgment of conviction he appealed to this court, and presents his case on petition in error and a case-made. He urges as one of the grounds for reversal of the judgment against him that the record as presented to this court fails to show that he was present in court at various step® during the trial, such as impaneling the jury, return of the verdict, and discharge of the jury.
