The defendant, Ovide Broussard, granted a special mortgage on certain real property, situated in the parish of Vermilion, consisting of 66 acres of land, with the buildings and improvements thereon, to secure the payment of a promissory note for the sum of $1,500, with interest and attorneys’ fees, executed by him, payable to his own order, and by him indorsed in blank. The mortgage contains no waiver of a homestead exemption. It is dated November 26, 1920, and was recorded in the mortgage records of the parish on the day following its execution.
