This was an action brought by the plaintiff against the defendant, as one of its employees, to recover damages alleged to have been sustained by him in having been thrown off the defendant’s road when going thereon in one of the-defendant’s crank-cars, in consequence of its alleged defective construction, and the negligence of the defendant. On the trial of the case the jury, under the chaige of the court, found a verdict in favor of the plaintiff for the sum of $2,500.0''.
