Income Properties/Equity Trust (“IPET”) seeks damages from Wal-Mart Stores, Inc. (“Wal-Mart”), for breach of an agreement to vacate a shopping center lease and for tor-tious interference with IPET’s negotiations with a prospective new tenant.
