Judgment of the Supreme Court, New York County (Dennis Edwards, J.), rendered on November 22, 1988, convicting defendant, following a jury trial, of assault in the first degree and sentencing him, as a persistent violent felony offender, to a term of imprisonment of from 20 years to life, is unanimously reversed on the law and the matter remanded for a new trial.
