LOKEN, Circuit Judge.
Thomas L. Romsey appeals the 108-month sentence he received after pleading guilty to a substantive drug count and a conspiracy count in violation of 18 U.S.C. §§ 2, 371, 1956(a)(2)(A), and 21 U.S.C. §§ 841(a)(1), 846. Romsey contends that the district court 1 erred in denying him a downward departure from his Sentencing Guidelines range because the government declined to make a substantial assistance motion under U.S.S.G. § 5K1.1.
