Appeal by the defendant, Sarah B. Cowles, from a judgment of the Supreme Court in favor of the plaintiff, entered in the office of the clerk of the county of Westchester on the 11th day of December, 1902, upon the verdict of a jury rendered by direction of the court, and also from an order entered in said clerk’s office on the 6th day of January, 1903, denying the defendant’s motion for a new trial made upon the minutes.

The plaintiff in this action is a foreign corporation, located and doing business as a banking corporation in Little Biver, Kansas. The complaint alleges this fact, and that on or about the 1st day of June, 1900, at Port Chester, N. Y., the defendant made her check, in writing, dated on that day, and directed the same to the First National Bank of Port Chester, N. Y., and thereby required the said First National Bank to pay to the order of W. W. Hiller & Sons the sum of $600, for value received, and delivered the same to the said W. W. Hiller & Sons.
