Memorandum.—Creditor’s bill. In the Circuit Court of Cook County; the Hon. Samuel P. McConnell, Judge, presiding. Bill dismissed upon the hearing of a plea; appeal by complainant. Heard in this court at the October term, 1894. Reversed and remanded.

The appellant filed a creditor’s bill in the Circuit Court on January 13, 1894, based upon a judgment in its favor for §1,531.79 and costs, recovered against the appellee, Bichard Graham, on November 22, 1893, and return of an execution thereon unsatisfied. The bill alleges that the execution on the judgment was issued November 23, 1893, and delivered to the sheriff on November 24th, and that a return thereon was made January 10, 1894, in the following words;

“ I have demanded of the within named defendant, Richard Graham, on the third day of January, 1894, money or property to satisfy this…
