The defendant was indicted for the crime of murder in the second degree. The offense was alleged to have been committed by shooting and killing one Robert Peasley at the town of Sidney, Delaware county, H. Y., on the 10th day of September, 1886. To this indictment the defendant pleaded not guilty. The action was tried at the Delaware county sessions in-March, 1887. The jury found the defendant guilty of manslaughter in the second degree.
