DIMOND, District Judge.

This is an action in tort for recovery of damages from the defendants for injuries claimed to have been sustained by plaintiff on or about August 21, 1949, through being struck by a motor car, the property of the defendant, L. T. Main, then driven by the defendant, Tom Main, the son of L. T. Main. Tom Main is of the age of 18 years. The complaint embraces averments charging the defendant, Tom Main, with negligence, and that such negligence was the proximate cause of the injuries to plaintiff.
