(dissenting). On October 23, 1929 plaintiff was in the employ of defendant, who was engaged in the general sawmill business. On that date he was handling slabs of timber and keeping them straight on what is known as the ‘‘slacker.” While he was performing these duties, his right foot was caught in the machinery and severe injury was inflicted upon the top of it. The skin and surface of the foot were abrased and the ligaments of the four small toes were torn loose.
