The bill in this case was filed by the appellants, Garnett and wife, setting up that the present terminus of the Jacksonville, St. Augustine and Halifax River Railway Company was at the head of the shell-road leading north of the gates of St. Augustine and about the line of the city limits; that said company is building their road into the city limits and intend to lay the said railroad on the side of a street next to the property of plaintiff, Mary J.
