MEMORANDUM OF DECISION

This adversary proceeding is a class action by Clarence Hall as representative plaintiff (“plaintiff”), against Sunshine Mining Company (“Sunshine”) and numerous individual defendants. Originally commenced in state court in Texas, one individual defendant removed the action to the U.S. Bankruptcy Court for the Northern District of Texas. That court severed the plaintiffs claims against the individual defendants and remanded those to the state court, and transferred venue of the action against Sunshine to this district.
