The city of Jacksonville brought an action in debt against the Chicago and Alton Railroad Company to recover penalties for the violation of an ordinance of the city and has appealed from the judgment in favor of the defendant.

The city of Jacksonville is organized under the general ■ law for the incorporation of cities, and since November, 1907, has been anti-saloon territory.
