—In an action to recover damages for legal malpractice and fraud, the plaintiff appeals from an order of the Supreme Court, Nassau County (McCabe, J.), entered March 12, 1992, which granted the defendants’ motion for summary judgment dismissing the complaint.

Ordered that the order is modified, on the law, by deleting the provision thereof granting that branch of the defendants’ motion which was for summary judgment dismissing the second and third causes of action, and substituting therefor a provision denying that branch of the defendants’ motion which was for summary judgment dismissing the…
