In an action, inter alia, pursuant to RPAPL article 15 to set aside a recorded deed, the defendants third-party plaintiffs appeal from (1) an order of the Supreme Court, Queens County (Polizzi, J.), dated September 29, 1995, which granted the third-party defendant’s motion to dismiss the third-party complaint, and (2) a judgment of the same court dated December 1, 1995, which is in favor of the third-party defendant and against them dismissing the third-party complaint.

Ordered that the appeal from the order is dismissed; and it is further,
