HTC Corporation and HTC America, Inc., seek a declaratory judgment that their telephony products do not infringe U.S. Patent No. 5,390,216 (“'216 Patent”) held by IPCom GMBH & Co., KG. IPCom counterclaims that HTC products infringe the '216 Patent as well as two other Patents that IPCom owns — U.S. Patents Nos. 7,043,751 (“'751 Patent”) and 6,879,830 (“'830 Patent”).
