BRETT, Judge:

Thomas Elmer Broaddrick, the appellant herein, was charged in Osage County District Court, Case No. GRF-81-104, with committing First Degree Murder in violation of 21 O.S.1981, § 701.7. He was represented by counsel and tried by a jury, with the Honorable Mermon H. Potter presiding.
