Reversing.
On May 26, 1937, the fiscal court of Monroe County adopted and entered an order providing for tbe issuance and sale of bonds in tbe sum of $50,000 to fund a floating indebtedness of tbe county in tbe principal sum of $44,383.56, together witb accumulated unpaid interest tbereon.
Thereafter Mitchell Richardson, a citizen and taxpayer of tbe county, on behalf of himself and all other residents and taxpayers of the county, brought this action under the Declaratory Judgment Act (Civil Code of Practice, sec. 639a-l et seq.) attacking the…
